this in my view is ridiculous and violates Burress Constitutional right to bear arms. 2 years is cruel and unusual in my estimation.
You have a constitutional right to take a loaded concealed
unlicensed weapon into a club and have it go off? Please enlighten me on how the 2nd ammendment can be interpreted that way. From the ESPN article this morning:
The gun was not licensed in New York or in New Jersey, where Burress lived, prosecutors said. His license to carry a concealed weapon in the state of Florida had expired in May 2008.
The charges were for two counts of criminal possession of a weapon and one count of reckless endangerment. I believe it's the reckless endangerment (the gun going off in a public place) that's getting him in the most trouble.
Most importantly, Plax has been trying to get out of this thing for almost a year now! At the time I remember reading something that all the DA wanted was for him to serve 12 months probation with community service, but Plax kept asking for continuances and putting off the trial date, and of course mouthing off about how he did nothing wrong and was going to get off, that he ended up pissing everybody off- the DA, grand jury, and judge.
All he had to do was come forward after the incident and admit his wrong-doing, and I'd bet he'd never be going to jail.
Quick edit- everybody who lives/works/plays in NYC knows that the city has some of the strictest gun laws on record. My lawyer friend was telling me that for Plax's crime the minimum he could have gotten was 18 months in jail. Whether you agree or disagree on principle, those are the laws on the books and you have to obey them.
