Being from Wisconsin we have lots of deer on the roadways. #1 lesson learned from my Father about deer when I got my license, NEVER under any circumstance swerve to miss a deer. Your car and your life are not worth it.

Insurance companies jack rates for driver induced accidents but minimally for deer hits. If the cause of an accident is because one swerved to miss a deer, insurance companies tend to view it as an at fault accident rather than a comprehensive claim. I.E. a big rate hike.

Even with hair in your bumper/fender, they will not view it as a deer hit as the damage is not consistent with a car-deer collision.

Best thing to do to avoid deer/animals is to brake heavily and aim for where the deer/animal was. If an impact is imminent release the brake and accelerate to raise the front end of the vehicle to prevent the animal from going through the windscreen.

When "No Fault" is directed at the driver of the car being damaged in the collision, I'd disagree and say there are potential circumstances where it is not the driver's fault. Whether you want to call it an accident or collision, some things just happen.

Give me an example of a "no fault" collision and I will show you where the fault is.

it could be the guy in front of you's fault. too much too little tire pressure? too old tire? wrong tire?

did he swerve before the tire ripped, or did he swerve because the tire ripped?

What is the speed limit on the highway and how close were you tailing him? I have the following distance numbers in my driving manual somewhere around here.

What was the tire from? Did it fall off a car or did it fall out of a truck bed or something. If it didn't come from a car, then it's the fault of the person who was in charge or loading and securing the load. If it broke off (wheel came off etc) then it's the fault of whomever tightened the lug nuts. If they were tightened properly, then it's the fault of the nut itself, or the stud.

Not matter what, there is fault.

It was just in the road. It wasnt from the car in front of me and no cars were pulled over missing a tire. I guess it is someone's fault from earlier on but no way to find out who's. The speed limit is 70 and I was doing 75'ish. I was probably 35 feet from the car infront of me but the tire was flying about 12ft in the air and landed in front of me. There were cars to my left and right side and a 18 wheeler behind me so the softest impact was the tire.

In one sense, you're very lucky. Road gators can be very dangerous. Glad to hear you're OK.
