Doesn't matter. He had worked out a deal with the prosecutors and didn't show up when he was supposed to go to prison fifteen years ago, then fled the country. It's not her call to arrest & imprison or not, he was a fugitive. France wouldn't arrest him but Switzerland would and they waited for him to go there for an award. Regardless of whether he was getting an award or not, if he's in public, that makes him available for arrest.
Rape is a crime against the state. The only reason "she didn't want to persue" gets someone off is because prosecution is so difficult with an uncooperative witness.

This is simply unfinished business between the courts and Mr. Polanski. It doesn't have much to do with her now. He is a flight from prosecution. They don't take kindly to that and I am sure there are more charges due to that.

That was probably for her own sanity and not to be eaten up with hatred for the rest of her life. I can understand that, but it shouldn't let him off the hook in the eyes of the law.
I think it was more a matter of France couldn't arrest him, because the extradition treaty didn't cover the offence for which he was convicted. I would be willing to go out on a limb and say that the average Pierre and Marie in "la rue", are as repelled by it as the average Joe.
Actually, France simply doesn't extradite its own citizens.
