BOULDER — A Longmont man accused of stealing more than $180,000 through a charity fraud was released from jail Thursday after a Boulder County judge reduced his bond amount.

Mark L. Schifter, 53, was arrested Feb. 26 after a grand jury indicted him on five charges, including theft of $20,000 or more, and violating raffle law by failing to get a charitable gaming license. The Colorado Attorney General’s Office is prosecuting the case in Boulder County.

Schifter was being held on $500,000 bond, but Boulder County Judge Gwyneth Whalen reduced that on Thursday to $10,000. Schifter was no longer in jail Thursday evening, according to a booking officer.

When Schifter was arrested, the Attorney General’s Office said he lived in Longmont and that Longmont Police helped investigate the case.

When defense attorney Steve Paulson argued on Thursday for the lower bond, he said Schifter owned property in Superior.

Schifter’s company, Perpetual Technologies, has a Louisville address.

Schifter is next scheduled to appear in court on April 13.

I called the BCJ Booking # just to confirm and was also informed the amount, $10,000, was posted by a bail bondsman. Perhaps we can all expect a statement in the not so near future on his website.

Oh, one more thing. When his bail went from $500,000 to $10,000, a condition of his bond was that he had to turn in his passport.

He's represented by an attorney, who has almost certainly told him not to make any statements whatsoever. Beyond possibly stating "business as usual, here's a new sale," I don't expect to see anything, at least nothing of substance.

Does that mean he won't be singing I Will Survive and that they've cancelled Real Audiophiles of Boulder County?

So he only came up with $1,0000 (or whatever percentage the bondsman takes)?
No idea. According to informaton on the Boulder County Sheriff's page, it's typically around 15% plus a fee. I'd imagine the house was put up as collateral and FWIW, I have no idea who put the money up. Pretty sure it wasn't Pu or Santiago.

Still no statement on the av123 forum...
perhaps bail was paid by an elt sail? Seems like they are trying to push business as usual image over there. Ignore the problem and it will go away. Some posts still appear to slip under the radar on their forum, maybe they should just shut it down for 6 months just to be safe....

Also I've notice that according to their site they have 9981 elt centers in stock. Apparently they have increased deep storage capacity, destroyed all replacement parts, and replaced them with centers that no one wants.....

somebodies humbly bumbly bumpety.....

I would like to say Thank God for Audioholics and this thread! Thank you for allowing it to be up and the truth to be known. No one else would do this and that adds major credibility in my book.

451.con where president indictments, undelivered product and refunds to consumers means "business as usual". How long can this go on, honestly? Wouldn't you think this is kind of a slap in the face to all the hardworking companies in this industry that have built up confidence and integrity with consumers over the years. In the end I bet some new consumers shy away from the ID model, shame.

Here is a few questions posed by an individual who donated money to raffles allegedly. Posting this just in case the thread gets deleted and it is entitled Raffles ? on their forums.

Raffles ?

--------------------------------------------------------------------------------
Will AV123 provide retribution to those that participated in the raffles? I put in $280 myself in good faith that the money would go to the people that they were advertised for.

His legal team has advised him not to speak on this matter but you can be sure that he'll have more to say when the time is right and then certain people will know what it's like to have such scrutiny as he's had. There are people out there looking to hurt him but he'll get them. Oh yes he will.

The above is a paraphrasing of many things he has said in the past, some of which Gonk has archived since it got deleted some months ago.

Some of that is no doubt completely accurate. I'm sure his attorney has told him in no uncertain terms not to say anything and to stay off the forums. Frankly, I don't expect to ever hear anything more at all.

It appears that chungar's post is already gone. In fact, I think that chungar got banned for his effort. There is a new one, though:

Amazing...say it ain't so Joe..er Mark.
The grand jury indicted Schifter on five separate counts, consisting of:

* Theft of $20,000 or more
* Committing a computer crime to scheme or defraud $20,000 or more
* Violating raffle law by failing to get a charitable gaming license
* Charitable fraud
* Use of an organization's name without authorization in connection with a charitable fraud

This has been a long and tedious road for many patient consumers who found themselves defrauded with these charities. It also represents a brief, but tumultuous rise and fall of a man, once said by Stereophile to be "well on his way to becoming a legendary figure in high-end audio".

The most recent online source posted that a call was made to the Boulder County Jail which has said that bail has been set at $500,000 (which can be provided by a bail bondsman subject to their individual policy.) Bail has not been met and Schifter remains behind bars as of Saturday.

With all that we've heard about Mark Schifter and the recent doings over at AV123, we have a feeling this is only the tip of the iceberg.
I wonder how long that post will last...
