I mailed it on 3/9. I don't intend to "clam up" but to do anything else would apparently be very stupid. I don't know what you guys expect me to do. Abboudc already said that he's going to sue me. I'm still here but I'm going to do my best not to comment further on the matter.
I would expect you to give Abboudc his $120(?) back and chalk this up to a lesson learned.

You do have an obligation to make sure a package arrives to the person you sold it to. Of if it didn't arrive, what the heck happened to it.

I am not sure why you are pushing back so much. This should be a case of:

Taking responsibility for not spending $0.65 for delivery confirmation. Abboudc doesn't strike me as scamming you. He may be, but you put yourself in that position by being penny foolish.

If you have been selling for 13 years, you know better.

Anyways, here's a tip. PAY FOR EVERYTHING WITH YOUR CREDIT CARD.

If they don't accept paypal find someone who does.

I just ordered vista from microsoft with my CC. At least i know i'll get it.

Something just occurred to me as i was checking out and Microsoft politely informed me via their terms of service that they're not selling software, just a license to use it. Jonnythan, did you purchase Vista with a CC?...i.e. can you prove you bought it? You can probably get them to ship you a new CD for $3....

That's a good point. M$ replaces media for $12 shipped I do believe.

I just want to chime in here. Both parties seem to be unaware of the post offices tracking system which is very good FYI. I have seen it firsthand when I worked on the machines for the USPS for one of their contractors.

I suggest you both contact the postal service regarding this package.

Johnny if you sent it via an envelope then it should be trackable. Most mail is sprayed with a orange ID bar code on the back.

Johnny you need to file a lost mail claim with the Postal Service. They may be able to find the piece.

There are a variety of things that can happen with mail. But usually if the sender addresses it. The mail can be found.

I fear it may already be too late.

I think a possible solution here that would be reasonable would be to split the difference in cost. I know Johnny wants his money and C wants his, but lets be civilized about this. Going to court is silly we are AHers so lets see if we can resolve this.

I was not aware of this. Looking at the USPS website, any claims for lost mail need to be made by the sender. From their FAQ:

Whom do I contact if I have not received a specific item?

If you have a tracking number for your item and would like assistance, please contact our Track and Confirm customer service at 1-800-222-1811.

A claim for a lost item must be filed by the mailer. If you believe you have not received a specific item in the mail, contact the mailer of the item to track the item or to file a claim.

13 years and no issue until now...I would say he has been pretty lucky the last 12 1/2 years. The responsibility is on the seller until the product is in the seller's hands. I've always insured everything at my cost, because my reputation is more important than a few extra dollars incurred on my part. Fedex and UPS is the only way to ship. Making a claim with USPS is like squeezing blood from a turnip.

The retail copy of Vista Ultimate w/SP1 that I ordered from Microsoft came today. Not bad, less than 5 days. Funky package and they don't make the CD Key easy to find.

Jonny, please lmk by EOD Monday if you'll be refunding my money. If i don't hear from you by then, i'll assume you haven't changed your mind.

i'm sure both parties here are NOT scammers. the package most probably got lost, but it really is the responsibility of the seller to get it to the buyer's hands.

otherwise, it will bring us to my second planned scam:
