MS had created an API that would have improved security and stability by restricting access to the kernel, but still allow anti-virus tools to be created. The EU saw the kernel restrictions as anti-competitive behaviour and disallowed the changes to Windows. This was a bad call by the EU as they failed to see the importance of restricting kernel access (like in MAC OS) and that contributed to the disaster last week.
