As I understand it, simple assault is a misdemeanor in DC. His J6 conviction is still on his record, however, because Trump commuted his sentence rather than issuing him a pardon. It seems unlikely that he'd be considered a first time offender. On the other hand, I doubt he'd get the maximum (180 days in jail).
Trump could of course grant him a pardon.
