I called and the clerk can't find any record of my case. She transferred me to another clerk however it went to VM. I left a message. I honestly don't think anything funny is going on here but I would like to know if the case is expected to be heard in the next few months.

Had he needed to make any testimony, he could have submitted it to the court with a "under penalty of perjury" HA HA HA... I just cracked myself up.

For those not familiar with legal proceedings, as mentioned by another poster previously, continuances are common, and heart surgery for the president of the company would be rather high substance justification compared to many. Hopefully small claims court will make for a much swifter resolution, as I have friends who have had to drag through loosely comparable situations (entirely un-related to MLS), and anyone who things litigation is a quick means to an end is kidding themselves.
