So I was finally hired about three weeks ago, working in the Kroger Deli. Nothing special, but I needed a job to get my life back on track. I was an good job if you ignored the customers.

They knew about my weed possession charge pre-employment. So they hire me anyway. I havn't touched anything for about three months now, and I pass their drug test. I was really happy that I would finally see some cash flow and be able to get myself back up.

I got a letter this morning informing me that I've been fired due to a background check.

I guess it's back to the old drawing board

Sorry to hear that. I'd suggest calling the hiring manager (or whoever is in charge) to discuss it. I wouldn't argue with the person, but just try to get some clarification about why the change in stance on their part. You might be able to talk them into reconsidering.

I completely agree with Adam on that.

For an employer to disqualify an applicant based on a marijuana possession charge is foolish! If anything, I'd rather employ the occassional pot smoker. They tend to be mellow, less anxious, and more collaborative.

They wasted my time, and their own time as well. I'm not sure why they bothered to hire me, only to fire me two weeks later. Now, they'll most likely hire some idiot who can hardly do his job.

If they would rather focus on that charge, rather than actually assess my performance, than so be it.

At least I'll still get paid for orientation and overtime for the holiday weekend I worked.

Were you given anything in writing saying you were hired conditional on your background check? If not, you may want to talk to lawyer. Similar situation happened to a college buddy of mine. Now he's getting his salary for the rest of his life, with a 3% increase every 2 years, without having to work

Don't you also get some compensation for a period of time? I mean, here if we fire someone I think its 30 days pay or something.

I know of a similar story so I would talk to a lawyer and get paid...........

I don't have money for a lawyer. I'm pretty much broke right now.

The key words are "at-will"

As sucky as it sounds, unless you had a contract, you may want to just put this behind you and move on.

My manager was told that I failed my pre-employment drug test. There is no way in hell that I failed it. I have no smoked a single gram of marijuana for the past four months. I havn't even as so much as taken a sip of alcohol.

I've been told that my manager as well as several other upper level employees are working on getting me back in.

I will gladly take another test if they want. I have a feeling I was just unlucky and got a false positive.

You take a lot of ibuprofen (Advil, Exedrine, etc.)?

That can cause false positives for herb.

Drug testing is bullshit and not very accurate.

Four months without smoking? There is no way you came up positive for weed. I'd guess it was false positive, I know a guy that's straight as an arrow and failed his drug test for his CDL on a false positive but he had 35+ years of clean tests and clean driving record to back him up on a retest.

THC can be stored long-term in fat cells - not enough for any actual side-effects, but enough to have a false positive. If you exercise recently, before the drug test enough THC could have been released more abundantly into your system to cause a false positive. If you are going to get retested I would recommend not exercising or participating in any strenuous activities (or eating any poppy seeds) for a few days before the test.

No offense meant to you Wafflesomd, but you said your your opening post that it was a great job if you ignored the customers. What do you mean by ignoring the customers, that usually won't get you far in a workplace that requires employee/customer interaction. I used to work at Kroger for their Deli department, customer service was very important. As a plus it was very entertaining how picky certain people were about how their meat was sliced.
