'Roy Ortiz of Broomfield, Colo. was saved from a submerged car during heavy flooding in the area last September, but he's now considering suing his rescuers.

Now, his lawyer told the Denver Channel, the rescuers shouldn't have taken two hours to free him.

"Of course he was thankful because those divers did have a major role to play in saving his life that day,” Ed Ferszt said. “That doesn't negate the fact that a mistake may have been made. I can understand why there's a lot of furor over people thinking that he's biting the hand that feeds. Does that mean that officers of North Metro Fire are above reproach?”'

I'll say a mistake was made. They shoulda left him down there.

The ability to file a lawsuit does not necessarily mean one will win it or even that it will not be thrown out by a judge at the earliest opportunity.

The very next time I come across a situation where I am about to save someone's life, I will have them sign a 2 page form detailing that if they survive I can not be sued by being able to save them. Makes me think twice about the good samartan thing. I say put him back in the water and let him think about it again.

Actually in California, there are Good Samaritan laws protecting both the person in need and the parties rendering assistance. Interestingly you are required by law to provide reasonable assistance. I'd be surprised if most other states did not have them as well. I'd actually also be surprised if the first responders aren't covered under city/state/some agency that governs them as well, unless the person in question is trying to say they didn't try to get him out fast enough because they figured he was dead already. That wouldn't be their fault or responsibility though, IMO.

Speaking of idiot lawyers, he really should not have told this reporter he thought this guy was an "undocumented immigrant". Yeah, I'm sure that's something his client wanted the whole world to know.

Hopefully this will just get dropped. A 'best effort' seems to have been made and in life we must accept basic human error as a reasonable reality. Unless something is presented up front to support that some legally specific error was made, then this case should go away. Then maybe they can deport that son of a b....

Sounds like a predatory lawyer to me. This is why school's are so jacked up now. Predatory lawyers will convince poor people to suit people as a way to get out of their situation of course the lawyer pockets the settlement and they get nothing in the end.

Oh, I don't know aboutthat. After that Fox inter view, the plaintiff may get more in the end than he bargained for. ...and the liar ....errr, lawyer will walk away scott free with tons of free publicity.

Don't know what's worse.
A predatory lawyer, or someone that's here illegally for 17 years. Cutting in front of law abiding immigrants going through the process legally.
I suppose once the lawyer becomes a millionaire, he could run for congress on a platform to Fight Income Inequality.:D
