Restrictive covenant provisions are tricky. I wonder if it applies if they fire you, instead of you quitting?

Thanks man. I made one phone call today to a compeitor and he asked me if I could meet with him late Monday afternoon. About 3 hours later he called me and said he didn't want to wait and asked if I would meet him first thing Monday morning. He said he knows me by reputaion in the field and he is sure he has a spot for me. Let's just hope he can afford me, I am willing to take a 20k hit if I have to but I can't go any lower than that.

I have seen companies that couldn't care less if you have a non-compete, I've seen companies that won't touch you if you have one and I have seen companies buy you out of them.

What usually happens is; if a company really wants you, they will hire you outside of your old territory, you work behind the scenes and feed your accounts into a different rep as you "cover" their territory and after the non-compete expires you actaully move back to your territory.

I don't think it matters if you resign or are terminated.

Hmm, my non-compete agreement hinges on me quiting. If they lay me off, it goes out the window. Since they threw an unreasonable quota increase at you, that could be viewed as a scheme to get you to quit, binding you to your contract terms. I think a lawyer of half-a**ed competence would be able to get it nullified, as it looks like the company is trying to push you out the door.

Most no competes are invalid if you are terminated, but of course read the fine print with your lawyer to make sure of it. I can't imagine it's legal to restrain your right to make a living if they terminated you...

I'm glad I do not have a no restraint. My boss in the past has wanted me to convert from managing inside to outside sales. I would make more money but the no compete would come into play... I'm just not willing to do it. I want my options open in case he gos full on alcoholic on me again and I have to leave.

Had an interview this morning that went really well. He did ask if I had a "non-compete" he said he didn't think it was going to be an issue.

He said I would hear back from him later this week with an offer and a territory plan.

Here is a little more detail of what is occuring. Pray for me guys!

With all the changes such as my unrealistic quota increase, firing Megan (my boss), firing Lori (my Clinical Liaison) and hiring the most pompous demotivating manager I have ever seen; I have decided that I can't work there anymore without compromising my own integrity.

I have planned a 4-6 week exit strategy with hopes that I can play their game until I get out cleanly along with taking my accounts with me.

I started my networking last Friday and things are moving way quicker than I had planned. I made 1 call to a sales rep of a competitor, whom I don't know and just asked her if there is anyway I could have her manager's phone number. She stated that she knew me from my reputation in the field and she was sure her manager would like to talk to me.

About 2 hours later he called me and asked what was going on. He stressed that he didn't have any openings but he would like for me to meet him at his office on Monday.

On Monday we met for ~2 hours and at the end, he said he was going to speak with the owner of the company about me as he didn't think either one of them were comfortable with me competing against them.

He called me back on Wednesday and asked if I could open up 2 hours of my day to meet with the owner on Thursday. The owner and I had a really good meeting and 2 hours later the manager called me back and said they are willing to open up a position for me and would like to take me to lunch today and give me a formal offer. I told him that I would love to go to lunch and move forward with our discussion but this isn't something that I take lightly and I need a lot of time to decide if this is the right fit for me. He said he understood and that it's not like they are interviewing since they don't really have an opening and he will give me time to decide but not forever.

My goal was to interview with a lot of different companies and slowly pick the right position but I like everything this owner stands for and I think he has a great business structure. This is a large, privately owned local company that has zero debt and a solid plan of building it for the next 12-15 years before selling it. My company actually tried to buy it early this year and he basically laughed at them. When they really pushed it he showed them the valuation and then said he would consider a sell at 10x the value; which showed them that it was not for sell.

A move here would get me away form the national corporate structure which I have learned to hate. It is moving quicker than I want but Carolyn thinks it's a sign that it's the right position. I have no idea what the offer will be but I would assume that they can't match what I make now. I have to keep in mind that what I make now will also go away next quarter since there is no way I can hit my quota. I need you all to pray, keep your fingers crossed and just hope that they make me a good offer.

Good luck Greg! Keep us posted after the offer. I do like the idea of working for a smaller local company and getting a feel for the owner and his management style.

The offer was good and it looks like there is still a little wiggle room left in it.

I spoke with my largest account and they said they will follow me anywhere.

I will discuss in detail with Carolyn tonight and spend the next few days thinking about it.

I think it sounds like a great opportunity. I did something similar a few years ago (OK almost 10 actually). I was working as the assistant MIS manager for a large company with a long established history. The salary was good, the benefits were great, 401K plan was very good... but the work was mostly unrewarding and the demands were ever increasing. However, none of the downside would have mattered that much if it weren't for all of the corporate politics.

I took a position initially as an outside consultant and later as an FTE with a much smaller company (former company had >3500 employees... new company had 22). Starting salary was less than 60% and no 401K, benefits were crap, etc... but I had complete autonomy and could pick my projects and was given a moderate profit-sharing agreement moving forward.

My workload still sucks (60+ hrs/week) - but after initiating several successful projects and managing a couple I'm now much, much better compensated (~10X my starting salary) - and other than the occasional heated discussion with the owner over company direction... there's zero politics and I'm much happier!

So, although the initial hit might seem a little daunting - I personally will never consider the 'stability' of the big corporate structure to be anything other than a potential nightmare waiting to happen. You can't afford as much complacency at a smaller company - but you can also see much greater rewards for hard work and dedication!

Good luck with whatever you decide. It sounds like you're going to come out of this just fine no matter what. :D

I accepted the position now just pray that a lawsuit is not filed against me. I am giving my letter of resignation next Monday.

I am out sick this week which seems weird as I am never sick.

I sure know what you are going thru Greg. You will be just changing to a different Manager wanting More, more.....it is just that way ....... I enjoyed jamming your set up....nice. Mike had "Great Customer Service " with SVS on the amp going bad. He has stacked his two sub now.wow I see where the next level of subs do for music. Got off topic.... I found it was easier to find a job while I had a job....... I usually made a $$ step up. But so went the demands..if high dollar sales was easy .............well you know. Hang in there. Retired and enjoyig my toys while a 60 year old Man still can.:cool: I still own Mike's old Vette..another $$ pit................addition.
