This issue really hits close to home for me now. I am going through a nightmare health care problem.

I find it safe to assume that your elected policians have legalized this fraud and/or are complicit in the theft of premiums with no intention of paying benefits.
Regulation requires oversight, oversight requires funding, funding requires sources of income (taxes), and generally speaking people don't want to provide that funding if they don't see
immediate benefits for themselves directly. I can write all the regulations in the world (like speeding), that doesn't mean I have the oversight capability (enough cops) to catch (pull over) and levy penalties (ticket) on every regulation violation (speeder).
Sounds more like medical ineptitude, than fraud. The doctors should have diagnosed this condition much sooner and if they had, BCBS would probably have accepted his application.
But then the doctors wouldn't make as much money, and the insurance companies would have no reason to jack up his rates. Does anyone honestly think this is a coincidence?
Call BCBS and ask for the number of visits that would have allowed you to be accepted and ask how they can deny your app if the reason for the extra visits was due to bad diagnostic practices. Move higher up the food chain, if necessary.
The fact that it's even necessary is exactly what's wrong with the medical situation here. To make matters worse, he pays for his coverage!
Can't wait for the follow-up that puts more blame on politicians and illegals for this guy's situation...
