NEW YORK (Reuters) – Two lawsuits have been filed over a gob of toothpaste.

Escalating a battle between two of the world's biggest toothpaste makers, Colgate-Palmolive Co (CL.N) sued GlaxoSmithKline Plc (GSK.L)(GSK.N) in Manhattan federal court, seeking a court order that its packaging for Colgate toothpaste does not infringe trademarks held by the maker of Aquafresh.

A few hours later, Glaxo filed its own lawsuit against Colgate in the same court, seeking to stop the infringement of its own marks.
Monster should sue them both for using their business strategy.

I can understand the positioning, as Aquafresh has been using the slogan and symbol for years...I remember that even from when I was a kid. It is blatant infringement to me, but that's corporate America for you.

I'm somewhat partial to GSK myself since I use their Sensodyne Tartar Control with Whitening.

And, as you say, they had the logo and "nurdle" design first.

It would be one thing if they wanted to use a different slogan at least, but they are basically trying to use something that is so nearly the same that it isn't funny. It is a dumb lawsuit and a waste of time and money. Just change the damn slogan...
