I spoke with a local attorney this afternoon, a random guy from google. Anyway, he said not going in was defiantly the right thing to do, and that I should hire him to harass the detectives, for a mere $1500... or I can wait to see what happens. :(

I don't really like the options... I guess I am just paranoid about them doing something stupid.
You told them to go pound salt. It will be the last you see of them.

The OP's problem was in how he was treated by the Police and while I have posted more than once that we don't have the whole story, neither does he. He wasn't there when the cops talked with the people at the store and unless there's a way to find out what was said and done, none of us will know.
I am not sure why there should be a direct correlation between the store's management with the police and then the police with the OP.

Should what the store clerks say affect the approach they take with a person of interest? I mean they could treat you like you're a Hollywood star busted for DUI or like you are Rodney King all based on a conversation they had with an employee.

Maybe cops should do a little more investigating. Showing up and immediately trying the "We know you did it, admit to it and it will go easier" is patently ridiculous. They aren't out for fact finding, just seeking a little blood. I have experienced this first hand when an acquaintance (not even a good friend) of mine broke into his neighbors house and stole $25K and had me pegged guilty by association. They showed up and started that whole routine. I let them know they have two options: Arrest me or leave the premises. I wasn't going to say another word w/o counsel present. Never did hear back after 13 years. Funny how that works.

Cops don't show up with that routine unless they have NOTHING. If they had something: You would be arrested and taken down town for an "interview" which is really an interrogation.

BTW, the best line I had heard from the police that showed up: "Well, you LOOK guilty" I actually laughed at the donut eating turd...

Not having been there, all we can do is speculate on what was said and by whom. The PD should have received a copy of the surveillance video without any comment by the store staff. That way, they could come to their own conclusions. If the store staff all stood there pointing at the video, saying "Yeah, that's the guy!", it's going to carry some weight, whether they're right, or not. At that point, lacing any other evidence, it's all the Police have to go on.

As far as going for blood- it's a freakin' electric violin, not $25K worth of stuff from a home. I have been involved in bigger retail theft incidents (I knew the check was going to be bad, so I called the same PD instead of Telecheck and they were caught a few blocks from the store) that had the detective coning into the store like it was the theft of a pack of gum. It's not a big deal for them and as I have mentioned, the mall around the corner is hit a lot harder and more frequently.

I could almost understand if they were being hard asses because they're just really tired of dealing with shoplifting incidents, though. For as much as it costs to deal with this kind of thing, they can have bag searches at the door, for all I care. My property taxes are high enough without people coming into the city, committing all kinds of crimes and driving the cost of the Police Department up. The number of officers has doubled in the last 10 years because of all of this crap and I'm sick of it.

I don't want anyone thinking that this is any kind of indictment of the OP, though.

The Police rely on the fact that not everyone understands their rights about interrogation and that many will fail to comprehend what's happening when the questions are fast & furious but from what the OP posted about the guy with the blond hair handling the instrument who looks nothing like him, if they really don't look alike, it should be fairly easy to say that it's not him.

Which is why cops show up and behave belligerent. Cops aren't out for the truth. They simply want to bag a kill. Regardless of what actual animal they are on the trail of.

Aside from the fact that your experiences have made you hate LEO, you still have to realize that they're not all the same. While they're there to enforce the laws, "bagging a kill" when it's a $1600 electric violin isn't exactly going to make them an instant hero or get that promotion to detective. It wasn't a violent crime, it wasn't an unresponsive 15 year old girl dropped off in someone's yard (who later died, as a result of drugs and alcohol), a hostage situation, a carjacking or a domestic abuse case. This isn't a big city- we only have about 14K residents but it's not Mayberry, either. Your PD is different- it has to be because your city has different things going on, at different levels.

When dealing with trained professional police officers there shouldn’t be. The police not the store employees are responsible for the police actions. Based on the limited information we have it sounds like the police were acting in this case the same way you said they treated you. They were on a fishing expedition hoping a quick assertive contact would gain either an admission of guilt or some overt sign of guilt leading them to escalate their level of contact.

Police officers will usually be weary of victim/witness statements unless they have corroborating evidence. In a case like this they may make an exception if they have a close working relationship with a store’s staff, in which case they may trust their judgment enough to take things a little farther than they otherwise might. In my experience it usually takes years and 100s of cases to reach that level because at the end of the day it’s the cops butt hanging out on the line if they go to far.

It sounds like there wasn’t a lot to base an investigation on. So I can only speculate as to why the police acted as they did but my experience indicates one of two likely reasons. They were idiots who usually just wrote traffic tickets and this was “cool” for them, or more likely they knew they had nothing to go on but figured if they rattled this guys cage they might get lucky. Thankfully, No!

I took the advice of the lawyer that I talked to, and did nothing. And so far, nothing else has come of it. They have my phone number, and they know where I live, so I am hoping they just dropped it.

After ruminating over what happened for the last week, I think that is where it will end. They were just trying to do their job, hopefully realized that it wasn't me, and are going on with their business.
