I'm pretty sure it's all legal.

Notice that they don't make any verifiable claims.

Everything said on that site is purely subjective and is simply someone's opinion, not hard, verifiable facts that can be tested.

How do they stay out of jail? There are laws against fraud, right?
A couple of points. First of all, you can break laws all day long, and as long as no one bothers to prosecute you, you can continue as long as you want. It takes money to prosecute people, and prosecutors have limited budgets. Also, a prosecutor has to be both interested in prosecuting, and have jurisdiction for the relevant area. If the fraud is taking place in one state, and a prosecutor in another state is interested in prosecuting, nothing will happen unless they can convince the authorities in the relevant jurisdiction to take action.

Second, in these kinds of cases, the claims are typically sufficiently vague that they may be difficult to prosecute (please note, however, that I am not a lawyer, and, even if I were, laws vary from place to place, so you should not regard anything I say as legal advice). And in the case of:

http://cls.audiogon.com/cgi-bin/cls.pl?accsrack&1207742831

I could be mistaken, but I don't see any claim for improvement at all! If they do not claim anything, then how can there be a case of fraud at all?

And at:

http://www.machinadynamica.com/machina31.htm

Again, what claim is made for actual performance? If no claim is made, then how can it be fraud?

Besides, there are plenty of phony psychics around, and plenty of phony faith healers, some demonstrated to be frauds (like Peter Popoff, who was exposed on national television in the 1980's, but was never prosecuted for fraud, and can currently be seen on TV doing the same kinds of things as he did before), but they are not usually prosecuted either. See:

http://en.wikipedia.org/wiki/Peter_Popoff

If you want the government to protect you from all of those things, you should vote for BIG government. VERY BIG government, as it would take an army of lawyers to prosecute all such people.

I think the biggest reason why they can't be sued, is that audio is subjective to all, and subjectivity cannot be sued against (typically). They sell something that improves something subjectively.
It would be like me buying a Wendy's Fish Sandwich and eating it while watching "Space Odyssey 2001"... did it improve my experience? It varies from person to person.

If someone bought a clock with a yellow sticker on it and placed it on their TV and said that it improved their experience, then it probably did for them.

However, they never mention technical benefits or physically measurable improvements, and they do not market the product that way. If they said that a clock placed on your TV(or whatever) made your screen 50" larger or filtered out noise from your antenna and it didn't, then it could be lawsuit material.

But since they say that it "generally improves" an experience, it's a lofty expecation. It would be like suing psycics for giving you a false tarot reading; they state the service as entertainment :D

Many people can be led to believe literally anything ...
I think you've summed it up right there.
Reminds me of a great little quote, don't know where it's from though.

"No one has ever lost money by under-estimating the stupidity of people."

Seriously, I have no life.
I think Machina Dynamica is some sort of ongoing performance art. They simply can't take themselves seriously, can they? Aren't they the same people with the "Telepathic Tweak" or something like that, where they play some clicks over your phone and you, like, hold it up to your audio equipment?
And the Quantum dots for CD players:D

Guys, I kid you not. I was relating this thread to my fiance and I showed her the pic of the outlet covers. She told me to call our 9 year old girl into the room. I asked the 9 yr. old if these outlet covers would make the home theater sound better and she gave me the greatest "are you smoking crack" look I've ever seen! It was great! Granted, my 9 year old can work all 6 of my remotes and when my fiance messes up the timing on the Harmony, the 9 year old can fix it.

Magic garbage.
I put these Big Little Bags over my speakers, and WOW. They do so much for the soundstage and bass response!

I'll get some pics tomorrow. They only cost $50 :D

Children are generally not stupid, as many adults imagine. They usually are simply ignorant of many things, and are often naïve about how the world works. But that is not stupidity; it is simply inexperience. It generally takes years of training to pervert someone's mind enough to get them to buy into all of the things that many "audiophiles" buy into. So I would expect that more adults are stupid and crazy than 9 year olds. 9 year olds have not had as much time to have their minds warped.

Last night, just for kicks, I put a Wendy's Fish Sandwich on the coffee table between me and my speakers. It widened the soundstage drastically (by comparison to the width of the bun) but made my music smell like tartar sauce.
