Yeah, I saw this... I'd look more into the Beyonce thing than this...
First off, the Mario Bros sample is all over electronic music and has been for a long time.
As a DJ, I pick up on where stuff was sampled from all the time. Video games, music, tv, sound effects, etc. People have gotten really creative with sampling and its made some great stuff (like, one of my favorite musicians obviously took 'drums' from Metal Gear Solid's sound effects...like picking up weapons and stuff)
In that video saying he ganked from the Finnish band, the guy in the video matches them in Sound Forge... mixing them together...and then they have the same Mario Bros sample...so, yeah, it mixes together pretty perfectly.
Timberland isn't my favorite, but, the guy has come up with some very popular beats. This fits his style, has roots that matches his other stuff, it doesn't really raise a red flag to me at all.
Every time I play out I look for tracks that mix perfectly, and if they use the same sample in some spot thats like a jackpot. In the same key (or even a different key, but, mixing by key usually sounds the best), and within a few bpm (because I can slow the pitch, rub the platter or spin the platter to match them up) I could get lotsa stuff to sound ganked. If it has the same sample used, then ****, its a jackpot.
