They have threatened Home Theater Shack with a trademark infringement lawsuit. I hope you will join me in the effort to stop this madness.

What kind of name is Ryan Ann Bickley? Is that a chick? Is it a dude? I know Rick wouldn't care because on a Twister mat there is no time to contemplate the niceties but as an observer I wonder. Under normal circumstances a declaration of gender would suffice but considering the profession of the androgenously named I am going to require pictures ... detailed pictures. Based on the impressive impressivity of those pictures I will decide which horse (no pun intended) to back in this race.

If Alcoholics Anonymous ever comes after Audioholics we can just have like half our membership join the other organization in what most would consider a legitimate but hostile take over. Throwing a kegger with some karaoke would pretty much guarantee that none of 'em would feel up to giving a sh!t what happens.

Now if only we could find a weapon as effective on Radio Shack's lawyer.
I just realized that Ryan can be a girl's name. If she's hot and provides pic's ... Down with HTS!

Seriously, I have no life.
Considering the fact that the US military used the term 'Radio Shack' long before the company started doing business, I think it's high time the government went after them for some do-re-me. If they play their cards right, the deficit could be wiped out and we could all stop hating Congress and Fearless Leader.

The "shack" is doing so poorly these days that they have to resort to this? I guess Shaquille O'Neal better watch out too!

I'm sure...

I'm sure that the registration date for hometheatershack.com precedes by a wide margin the use of simply 'The Shack'.

Maybe they can get Kurt from BJC to write their response. Something like the more our customers realize we have nothing to do with Radio Shack the better.

Or, have an old Southern Gentleman in a white linen suit and thin black tie walk in looking like Col. Sanders and, in his best drawl, say "Suh, you ah a pultroon of the worst kahnd and ah demand that you not sully mah company's good name by associating it with yoahs. Make this silliness stop at once, or ah will be forced to seek satisfaction bah all means necessary, in this matter".

If the HTS was nothing but a web forum, I might be up in arms. But as was pointed out many time when Audioholics started the AH Store, things are now different for them.

HTS also operates an on-line electronics store that would to an extent compete with Radio Shack:
http://www.hometheatershackstores.com/

In the case of the companies using the "Monster" name, like Monster Golf, they were not operating a business in the same market.

The first Radio Shack store was opened in 1921

There are more than a few problems with this. I believe that HTS has been registered since 2005. That is half a decade gone by with out TRS asserting their rights to anything. 2ndly the only part of the name is the word shack. Not uncommon. I would assume that this is only a problem since TRS started with branding their stores with a more 'hip' name simply known as 'The Shack'.

HTS isn't even branded in any way to confuse any un-knowing bystander that would accidentally land at their page.

I believe a jury would come to the conclusion that there would be no confusion when it all comes down to it.

Looking at the HTS store, there's really nothing they have in common with radio shack.

It's just an amazon store really. Problem is a little forum doesn't have the resources for a legal battle, but Kurt is helping out and that guy continues to show why Blue Jeans Cable is one of the best companies in the business.

This reminds me too much of this case.

I think its nothing more than harassment. I'll be sending an email.
