Seriously, I have no life.
It seems to be well past BJC response to Monster and the time limit set by BJC.
Any inkling what is happening in this duel? Maybe BJC will do what Disney didn't, take them to the cleaners.

I've been wondering about that myself. I hope BJC sticks it to them! Anyone have any info please share....

I'm not sure in this case if no news is good news. I wouldn't put it past Monster to take it to court anyways just to show due diligence while trying to "protect their legally copyrighted and trademarked name."

In BJC case, they claim of some design patent violation, not infringement of their beloved name:eek:
Anyhow, BJ indicated they would keep us informed and their letter had a deadline for Monster to provide the needed documents.
I am just wondering if in the end, BJ signed some sort of agreement in secret like Disney who, apparently was able to take Monster to the cleaners but didn't:mad:

The last communication from Kurt was that Monster has not responded to his reply. Unless this has changed, what do you want Kurt to do? Give weekly updates that Monster STILL hasn't responded to him?

To imply an under-the-table deal is a bit low, don't you think?

Remember, Monster's letter to BJC, although showing cojones in trying to intimidate BJC, does not mean that they ARE going to take BJC to court, just that they THINK (or just want BJC to think) they have cause for action.

Kurt's response simply stated that he doesn't believe they do have a case but if they want to try to go for it, he's ready and more than willing and able to give them a good run for their money.

Since no legal action was initiated by Monster, they have no legal obligation to respond to Kurt's letter. They can just walk away, which might be prudent.

I don't think any "deals" were needed. BJC benefited greatly by the publicity here, in other audio forums, and in other, more general general sites. What would BJC benefit by cutting a deal with Monster? the more Monster pushes, the more sympathy and good will is heaped on BJC.

I asked Kurt in one of the other BJC v Monster threads if there was any deadline, legal, implied, or industry standard, for Monster to respond. He said there isn't. So basically they could come back at him in 6 months or a year if they chose.

If your cables from BJC start coming with an insert touting Monster or you see a link on their homepage, you'll have have the answer to the 'secret agreement' question. That seems to be how Monster works it.

Personally, I see it as Monster backed off for now until their legal team can come up with a better approach. I feel they'll be back bothering BJC at some point in the future.

I didn't see a last communications from Kurt. Was this after his letter deadline to respond to his letter came and passed?
And if it did pass, why would that not be the end?
Of course M is intimidating but is there no obligation on their part to respond to Kurt's letter one way or another in a timely manner?
