So much for Noel Lee's "we're not litigious" claim....

I should note that in addition to the 25 items on that docket summary, there are many, many trademark filings at USPTO. Some of those are minimal, but some are full-blown contested proceedings which have all the attributes of a lawsuit, down to formal pleadings, discovery, and motions practice--for example, the current one against Monster Republic.

Yep. that link can only do 4 years back.
I have seen links that go back 20 years or more and monster has a very long list of attacks.:mad:
These at the link must be ready for trial as a judge is assigned?

No, it's impossible to say what the status of those 25 cases is from the info at the link. You have to look each one up individually on the federal docket system and check status. Chances are that the earliest ones are all concluded, while the latest are all pending. Assignment of a judge in the federal system happens upon filing, so that doesn't mean anything in itself.

Bear in mind, too, that this is only United States District Court lawsuits. If they've sued anyone in state court, that'd be elsewhere. Also, USPTO proceedings are not on this report, and as I've mentioned, there are a lot of those--dozens if not hundreds, last I saw.

Maybe suing is their business and the cable is a sideline?:D

Judging from the shelf-space changes I've been seeing in the big-box stores, that sideline is getting narrower all the time....

Really, it's very hard to explain just what's going on over there. Bad legal advice, very likely, has a tremendous amount to do with it. Consider this: in the tort world, where people complain that there are tons of frivolous lawsuits, most lawyers take cases on contingency and so have an incentive to avoid cases they can't win. In the IP world, where very little work is done on contingency, there is very little short-term incentive to advise a client NOT to sue a potential target, even if the case is utterly frivolous. Advice not to sue amounts to a small bill; advice to sue results in a large bill, win or lose.

While it didn't go all the way, this one would have been fun. Unfortunately, Monster dropped their trademark suit against the seller of the Monster Deer Block. Attorneys for the Block company successfully convinced Monster Cable that the average consumer would not confuse a salt lick with audio cables.

I would love to see that. How about Monstor audio. There is no E so how could anyone who can read the English language get that confused....:eek:

How would a clothing or golf place be confused with a wire store?
