Kari Lake's Lawyers Take it in the Shorts (Again)

Lake's lawyers, including Alan Dershowitz, were hit with Rule 11 sanctions and Section 1927 sanctions in Federal Court on December 1, 2022. Rule 11 sanctions are a big deal. It forever taints a lawyer's professional reputation.

>>>The court imposed Rule 11 sanctions on plaintiffs’ counsel for the two false statements of fact, but it refused to penalize them for filing the lawsuit for illegitimate, non-legal ends. . . . But Judge Tuchi did impose sanctions under 28 USC § 1927 for multiplying the proceedings “unreasonably and vexatiously,” . . . So Alan Dershowitz, along with attorneys Andrew Parker and Kurt Olsen, will be jointly and severally liable for the Maricopa County Defendants’ attorneys’ fees. It’s an ignominious end to the Harvard emeritus professor’s long legal career, and an even more ignominious end to the Big Lie claims brought by Donald Trump and his acolytes.<<<

But, her not-so-merry band of losers, er lawyers, apparently decided they wanted to experience an epic *ss-kicking in state court as well:

>>>So naturally this team of weirdos filed yet another election challenge, this time in state court in Maricopa County, demanding to be crowned the winner of the November 8 election.<<<

Leading to . . . . drum roll . . . an award of about $28K to the defendant Secretary of State Katie Hobbs.

Lake's almost instant loss in court was 100% predictable, but it was somewhat surprising that the judge didn't award sanctions. Oh well, there's always next time.

Perhaps Judges Tuchi and Thompson are keeping their powder dry for when Lake shows up with her next legal team, Dewey, Cheatem & Howe.

What a tough job it is to be a lawyer after all. It seems to me that to be a good lawyer you have to learn it for many years. I think the court imposed sanctions correctly.

Her lawyers haven't quite taken it in the shorts yet again, but it sure looks like the latest trial is heading in that direction:

>>>Kari Lake on Wednesday opened her (second) trial challenging the 2022 election ... with a complete and total fizzle.

Her attorney, Kurt Olsen, told the judge he’d be presenting evidence that Maricopa County didn’t verify the voter signatures on “hundreds of thousands” of early ballots, instead hiring signature reviewers who just went through the motions while the county looked on.

“This isn’t a question of not doing it well enough,” he told judge. “They’re simply not doing signature verification.”

Then Olson called his first witness: A “whistleblower” who proceeded to annihilate Lake’s case.<<<

On the other hand, this report is just an opinion by one person so it should be taken with a grain of salt.

The judge recently administered a well-earned final bench slap to Dershowitz:
>>>Whether Mr. Dershowitz signed, or intended to sign, those filings as “counsel” or “attorney” or “of counsel,” he signed them. And he effectively conceded that he authorized his signature on these filings without investigating whether they were legally and factually sound. If there was any doubt this brought him within the ambit of Rule 11, the evidence detailed above demonstrates that all parties involved understood the value of his signature.<<<

As I mentioned in a prior post, Rule 11 sanctions are very serious and they forever taint a lawyer's reputation.

Today's episode of "Kari Lake's Lawyers Take it in the Shorts" is brought to you courtesy of judge Adleman:

>>>PHOENIX — Kari Lake is now going to have to prove the charges she leveled against Maricopa County Recorder Stephen Richer are true if she wants to avoid being found guilty of defaming him.

In an extensive ruling Wednesday, Maricopa County Superior Court Judge Jay Adleman said it is clear that the claims made by the failed Republican candidate for governor that Richer had sabotaged the election were not, as her lawyers claim, “mere rhetorical hyperbole.’’<<<
