House Votes to Ban Obesity Blame Lawsuits

WASHINGTON -- The Republican-controlled House voted Wednesday to shield fast-food chains from lawsuits that blame them for making people fat.

Nicknamed the "cheeseburger bill," the measure stems from lawsuits accusing McDonald's of causing obesity in tens of thousands of children. The food industry has asked Congress and state legislatures to protect it from liability, and so far, 21 states have agreed.


"You cannot litigate personal choices and lifestyles," said Rep. Mike Rogers, R-Mich.

House Judiciary Committee Chairman James Sensenbrenner, R-Wis., said potential costs from the lawsuits threaten the food industry and its 12 million employees and raise food prices for consumers.

"These suits would be laughable if they were not so harmful," Sensenbrenner said.

The measure, which won approval on a 306-120 vote, would prevent class action lawsuits blaming restaurants and food companies for weight gain or obesity. The House passed a similar bill last year, but the Senate ran out of time to act.

Two-thirds of American adults are overweight, and nearly one-third are obese, while obesity among children and teenagers more than doubled in the past 30 years, according to government estimates.

Critics of the bill contend that a better way to make people responsible for how they eat is to require nutrition information on menus and menu boards.

"But of course this silly legislative effort has nothing to do with encouraging personal responsibility and everything to do with pleasing a powerful and politically connected industry," said Michael Jacobson, director of the Washington-based Center for Science in the Public Interest.

A food industry lobbyist said lawsuits against food companies are the wrong way to fight obesity in America.

"More energy must be put into solving the problem of obesity, and less into assigning blame for the purpose of collecting legal fees," said Hunt Shipman, executive vice president of government affairs and communications for the Food Products Association.

Courts have dismissed most obesity claims, but an appeals court in New York reinstated one lawsuit against McDonald's earlier this year. It is still pending.

I'm glad to see there's at least a shred of common sense left in this country. People have to learn not to be children their whole life. If you're fat, don't blame someone else- get off your fat arse and do something about it.

The trend in our country is to blame someone else for our own actions. I'm sympathetic to the fast-food industry, but our country has already set a precedent with the tobacco companies. People seem to be ok with tobacco companies paying out lawsuits to people who do not take responsibility for their own actions. I don't see a difference between the two industries.

Well if the trend went similar to suits against Bartenders and drunk driving accidents I could imagine scenarios like this.

Large Man: I'd like another Triple Cheeseburger deluxe with bacon please

Server: I'm sorry sir, I'm afraid I have to shut you off

Large Man: Oh, come on, just give me one more burger and a shake

Server: nope, you've had enough, time for you to go home

Large Man: What, are you sayin I'm obese! Give me another burger

Server: Sorry sir, you're all done, no more food for you



Having been told by my doctor at my last physical exam that I could lose some weight, I suppose I could find my photos posted at the local fast food joints with "Don't accept orders for anything but salads from this man"

Very funny BostonMark, and sadly true. I'm thinking about suing the girl who sat in front of me in science class for making my pants tight all through highschool, and my pot dealer for making me smoke way too much pot. (kidding about the second one)

Why is it so hard to just run around your neighborhood for a half hour?? How hard is it to do a few pushups and a few situps?? How hard is it to do simple things like this to keep you in moderate shape, no matter what you eat??

Plus, chicks find guys who are slightly fit incredibly attractive. See, cardio exercise is good for two things.

1. It's healthy
2. For the ladies. ;)

They've (the trial lawyers) tried the same tactics on the firearm manufacturing industry. Some moron shoots somebody and it's the manufacturers fault.

Putting lables on cheeseburgers isn't going to help anything. Thanks to the educational structure in this country there aren't that many who can both read and comprehend. ;)

That's the key to the debate and I agree with it.

How about the lady that put a steaming hot cup of coffee between her legs and then sued McDonald's because it burned her? She actually won the lawsuit. I guess her defense was, 'Yes, your honor, I am a moron and put scalding hot coffee between my legs, but McDonald's should have known that there are idiots like myself around and should have protected us from ourselves.'

Personal responsibility is lacking and the easy way out is to blame someone else for your mistakes.

What are all those fat, lazy people going to do next? Blame couch manufacturers? "My *** fit's perfectly into that couch..." TV and cable networks? "I HAVE to see what the next big reality show is..." :rolleyes:

The lady who sued McD's did win, but it was appealed and the settlement modified. Instead of 6 million, she got about $300K, which is still too much for her basically being stupid.

The jury award was ~$2.7 mil, and the court later reduced it to $480K. My beef isn't as much with her (81 year old decrepit lady) as it is with the 12 jurors who awarded the damages in the first place ("an order of fries and one serving of a dozen idiots, please")! The jury said they put the award as high as they did to punish McDonalds for its arrogance. HUH? (Others had been injured by hot coffee and McD's never ordered their coffee temperatures turned down, in spite of those injuries/complaints.)

So if you want a good cup o' cold joe, you know where to go, now. :(

Most of these cases just sicken me and they should never get to a jury in the first place. A judge just needs to read the complaint and be able to say "It's your own damn fault! Now give me 50 bucks for wasting this courts time."

As a avid freestyle cyclist (www.bmxtrix.com) I put myself into harms way intentionally every time I ride my bike. Just like anyone playing any sport, I have the opportunity to seriously hurt myself. What sickens me, is that every now and then I hear about a court case where someone is suing a skatepark because, in a word, they were stupid.

A 10 year old kid goes to a skatepark with his dad. The kid rides into the park then straight down into a 10 foot ramp and breaks a couple of bones or is paralyzed or something. The father sues and says "How was he supposed to know about such things?"

Dang! People need to take responsibility in ALL areas of their life.

The McDonalds case is just as sickening.

About as sickening as the file sharing lawsuits going on right now.

She was 81? Poor old lady and her burnt crotch. I feel bad for making fun of her when that story 1st broke. But I refuse to feel bad for people who eat 8 cheeseburgers and wonder why they're fat.

I feel bad for her - sure. But, if you actually read the details of the case, you will find that there is no indication, at all, that McDonalds did anything wrong. AT ALL!

Yeah, I feel bad for anyone who hurts themself unintentionally. Someone needs to drop a desk on their foot, then sue Ikea. Send a message! No, if it is an accident, then let it be an accident.

McDonalds did not owe that poor woman one darn thing though. Not even an apology - or even a free cup of coffee. I am sure they would have been happy to give her a new cup if she just dropped it though.

1. The coffee was under recommended industry standards for serving coffee.
2. The coffee was in the same container they still use for serving coffee.
3. WHY ARE JURORS SUCH MORONS?!?

Ah well, welcome to America - how may I sue you today?

Kind of a PM thing - but I've been riding flatland (no ramps) for 18 years. Probably my peak was 10+ years ago when I rode pro, was ranked #2 nationally and spent a year touring.

Now it's just for fun.

I do see one key difference- the tobacco companies had the science that told them cigarettes were harmful well before even the surgeon general did. While we take it for granted now that smoking will kill you, this wasn't always the case. Not only did they knowingly sell a lethal product for decades, they actually pioneered additives that made smoking even more addictive. That's the real reason they lost their bazillion dollar lawsuit- the fact that they scientifically tested hundreds of dangerous substances until they found the most effective chemicals to addict you.

Still, I agree with the general gist of your argument. Anyone who starts smoking now, today, in 2005, really deserves to die and I have no sympathy for them whatever. And it will be suicide, not the fault of the tobacco grower or vendor.
