As this is the two-month anniversary of my purchase of this receiver, I must finally admit defeat and acknowledge that I've been had – Regardless of the many assurances via email I’ve received, I’m sure no equitable resolution will be forthcoming.:mad:

This item was so badly packaged, the local FedEx guy thought it had been deliberate to cover previous damage. I had no reason to believe that, so I went under the assumption the packager was just inept. I did agree that there was no chance a claim would be paid, so I tried to work things out with the seller. I thought we had agreed on a fair solution.

To the seller: Didn’t I deal fairly with you?

-I paid immediately.
-Un-asked, I paid a bit extra to cover your Paypal fees.
-I communicated every action I took with the receiver, FedEx, the repair facility.
-I made an offer that covered your original costs.
-I waited very patiently for your responses.

-You delayed shipment – Fine, you were busy.
-You claimed the unit was 1 month old – Fine, you bought it on ebay 1 month ago. I suppose it was a month old to you (While not exactly part of this transaction, you also claimed to another member that the reason you had so much equipment to sell was because you acquired many pieces from a relative. It seems most of the items listed here were purchased by you (as “rocbuster”) on ebay – Fine, nothing wrong with a little free enterprise).:rolleyes:
-It was your poor packaging that caused the (pretty substantial) damage. Fine, not everyone has the skills… Well actually, it was pretty bad. Packing peanuts in a single box wasn’t much protection for a 40 lb. Receiver.

All this could be understood/forgiven. But:
-You indicated acceptance to an agreement that you had no intention of honoring. At first I thought it could be financial reasons – but you’ve been plenty active on ebay, so I guess the reason is less complimentary (By the way, from the recent negative feedback, I must not be the only one unhappy with your treatment).

You should be proud. I’m sure the delaying game was intended to do just what it did – get me to go away. Sure… Go away mad, go away disgusted, go away poorer… just go away.

Well, you win. I’ll pay for the repairs and leave you alone.

Generally, people without responsibility, conscience, and honor don’t give these things a second thought.

I’m sure you won’t.

Ahhh, I have been waiting to say this:

On any board or forum, Audioholics or Ebay, when two parties enter into an agreement to purchase/sell it is a LEGALLY binding agreement. Lord knows I had my struggle with someone that called me back to accept my offer of purchase and then backed out. Only made worse by their posting to make it sound like the item was off the market due to equitable arrangement and present an air of reasonable and responsible party that one could trust to deal with.

BTW, small claims court only cost ~$35 to file. You have pics' you have email. Take his *** to court. When he doesn't show, you get a default judgment. Wait till they try to get a mortgage or car loan. You will get the call.

A quick story about how it worked for us: We had a business using our software that was 2 years outside their initial support. New owners called up needing help. Sure no problem. Our policy, you pay the back support plus agree to an additional year (only $40/month). They sent in a purchase order, we trained new staff and cut new licensing. They didn't pay. We called them up and found out after we got them trained they thought the system was so easy to use, they shouldn't have to pay. That's ok, to court we go. They don't show. We win.

2 years go by, they call us because they can't lease $120K in equipment... Trust me, we had the last laugh. Good luck in running your business without new equipment.

I sell a bit on ebay. Davidtwotrees.
I recently had a Lexicon DC1 prepro. I didn't have it long, and decided to sell it. I took a small loss but the buyer paid me $225 shipped. He got it and claimed the digital outs weren't working. I was sure they were when I shipped it. I did say in my shipping notes that there was no returns unless DOA. The guy said he wanted his money back, so he sent it back and I paid him for it, plus most of the return shipping.
It sucked, and I regret buying/selling the unit, but you know what? The buyer didn't sign on for a unit that only half worked.

As to shipping, don't get me started! First I put the unit in a garbage bag, then bubble wrap. I put a small amount of peanuts on the bottom of the box. Then I cut to fit some two inch pink styrofoam insualtion. I set the unit on that, then surround it with the pink rigid insulation, with peanuts in between the rigid and the box. If the unit is a heavy amp, I will double box it, with peanuts in the outside box. Packing is critical. Just throwing peanuts in a box is unacceptable! Heavy electronics will wiggle right to the bottom of the box.

I find most people on ebay honorable. Often when negative stuff happens, I think there are life problems involved be they divorce, legal, etc, etc. Hope you can resolve this.........

I agree. I've had more than 200 transactions on ebay, both as buyer and seller, with no neg feedback and very few issues. I've found, with good communication, most people are very reasonable - they just want to know what's going on.

In fairness, until my rant above, our emails have all been cordial. Even when describing the poor packaging, it was a friendly note and I let the pictures do most of the talking. His emails were equally friendly. For weeks, I thought the deal was salvagable. I knew I would need to pay for repairs, but could still end up with a working (but maybe not pretty) unit if we could work something out. I thought we had. But, that's when communication broke down. I'd send an email asking about the deal - he'd reply that he'll take care of it. Then nothing for a couple weeks until I ask again.

In any event, I'm done with it. I've already worked on the repair process, and even though I might end up paying more than a new unit would cost, I'll finally get my 7.1 system operating.:)
