Trump's A$$ Handed to Him By 2 Courts In One Day

Today's episodes of "Trump has his a$$ handed to him in court" are brought to you courtesy of the federal Court of Appeals in DC, and the DC District Court.

First, he lost his presidential immunity claim on appeal in several January 6 civil cases that were consolidated for purposes of appeal:

>>>Former President Trump is not immune from civil lawsuits blaming him for the Jan. 6, 2021, attack on the U.S. Capitol, an appeals court ruled Friday.

The appellate court was asked to decide whether Trump’s false claims of election fraud and rallying cry for supporters to gather at the Capitol and “fight like hell” was outside his presidential responsibilities, meaning he could be held liable for it under U.S. Supreme Court precedent.

A three-judge panel affirmed unanimously that Trump’s post-election efforts to subvert the 2020 election results were done in his capacity as a presidential candidate — not a president.<<<


He also lost a somewhat similar argument in the January 6 criminal case:

>>>A federal judge on Friday rejected former President Trump’s argument that he is immune in his 2020 election subversion criminal case, while also denying his other constitutional defenses.

“Whatever immunities a sitting President may enjoy, the United States has only one Chief Executive at a time, and that position does not confer a lifelong ‘get-out-of-jail-free’ pass, Former Presidents enjoy no special conditions on their federal criminal liability,” U.S. District Judge Tanya Chutkan wrote in the 48-page ruling. . . .

“Defendant’s four-year service as Commander in Chief did not bestow on him the divine right of kings to evade the criminal accountability that governs his fellow citizens,” she added in her decision.<<<


Judge Chutkan nailed it. Presidents are not kings. This is one of the most basic principles of our system of government. Trump will undoubtedly appeal the decision, but he has precisely one snowball's chance in hell of winning on appeal.

It's nice to see some of Trump's garbage legal arguments getting cleared out of the way.

Somewhat the nature of both I'd think. Everything in courts have been dragged out somewhat since covid that I've seen....part of drumphy's grand scheme perhaps? LOL

Trump is attempting to delay the January 6 criminal trial by filing an appeal.

>>>But in asking to stay the proceedings, Trump’s attorneys bashed Chutkan’s decision.

“The Court incorrectly denied President Trump’s claim of Presidential immunity on the ground that such immunity does not extend to federal criminal prosecution for a President’s official acts,” they wrote.<<<

In other words, Trump is effectively arguing that he is a king. Peering through the bluster, Trump does not identify any text in the Constitution or any court rulings to support his arguments. It's a bare assertion that he's entitled to some sort of "super immunity" to commit criminal acts that has never been recognized by any court.


The following article is quite well written and touches on the topic of potential delay due to the appeal:

>>>Perhaps the most immediately important issue arising out of these two cases is the question of whether Trump will succeed in getting proceedings stayed while the D.C. Circuit and the Supreme Court consider Judge Chutkan’s ruling. Trump is entitled to an interlocutory appeal of that ruling, which is to say that he doesn’t need to appeal it in the context of a final judgment of the case; he can bring the appeal now. His trial is also set for March 4. This sets up a potential clash between the appellate timetable and the current trial schedule.

One possibility is that the D.C. Circuit will consider the appeal very quickly—and that the Supreme court will too—thus resolving the immunity question before the trial is set to start. But that’s no sure thing. So the question of whether the appellate courts will let trial preparations go forward as they consider the appeal will become increasingly important as the appeal gets under way.<<<


My best guess is that the DC Circuit and the Supreme Court will decide the issue quickly to avoid delaying the trial.

Given the Sixth Amendment right to a speedy trial, it is somewhat ironic that Trump is trying to do the opposite, namely delay his trials as long as possible.

>>>In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial . . .<<<


Of course, a defendant's right to a speedy trial does not imply that a defendant is required to exercise this right.

My best guess is that the DC Circuit and the Supreme Court will decide the issue quickly to avoid delaying the trial.
This might go even quicker than my best guess.

And, true to form, Trump (through his campaign people) is having a meltdown fit for a toddler.
